Long Load Carrier System – Disclosure, Liability Disclaimer, and Safety Warning

IMPORTANT NOTICE – READ BEFORE USE    By purchasing, installing, or using the Long Load Carrier System (the "Product"), you (the "User") acknowledge and agree to the following terms, warnings, and disclaimers. Improper use of this Product can result in damage to property, personal injury, or death. The manufacturer, seller, and any affiliated parties (collectively, the "Company") disclaim all liability for any damages, injuries, or legal claims resulting from misuse or failure to adhere to the safety guidelines outlined below.

1. PRODUCT INTENDED USE & LIMITATIONS    The Long Load Carrier System is designed exclusively for securing long items (such as lumber, pipes, and outdoor equipment) to the side of a motor vehicle for temporary transportation. The Product must be used in accordance with all local, state, and federal transportation laws.                                                   Maximum Load Capacity: The system is engineered to secure loads up to 300 lbs per strap when properly installed. The lighter version supports up to 75 lbs per strap. Exceeding these weight limits may result in product failure, vehicle damage, or personal injury.                                                                                                                                                                           Vehicle Compatibility: The Product is designed to be a universal fit for various vehicle types, including sedans, SUVs, and trucks. However, fitment is not guaranteed for all vehicle makes and models. The User is solely responsible for verifying the compatibility of their vehicle before use.                                                                                                                                 Weather & Road Conditions: The Product must not be used in extreme weather conditions (e.g., heavy rain, high winds, snow, or ice), as these may compromise its effectiveness and safety.

2. SAFETY WARNINGS & REQUIRED PRECAUTIONS  Failure to follow these warnings may result in serious injury, death, or legal liability:   Proper Installation Required: The User must carefully follow the installation instructions provided. Improper securing of the straps, hooks, or load may lead to detachment while driving. The load must be centered, balanced, and secured tightly against the vehicle to prevent shifting.  Pre-Trip Inspection  Before each trip, the User must inspect the straps, hooks, cam buckles, and load for signs of wear, damage, or improper attachment.  Loose or damaged components must be replaced before use.  Obstruction & Visibility:  The Product must not obstruct vehicle lights, mirrors, license plates, or driver visibility.  If any part of the load extends beyond legal vehicle dimensions, the User must comply with all local regulations regarding warning flags, lights, or markers.  Speed & Driving Adjustments:  The maximum recommended driving speed with a secured load is 45 mph. Higher speeds increase the risk of wind drag, shifting, or detachment.  Sudden stops, sharp turns, or aggressive acceleration should be avoided.  Liability for Property Damage or Personal Injury:  The Company is not liable for any damage to the User’s vehicle, cargo, or surrounding property caused by improper installation or use.  The User assumes full responsibility for any injuries to themselves or others resulting from product misuse, failure to follow instructions, or disregarding safety precautions.

3. LEGAL DISCLAIMER & LIMITATION OF LIABILITY   A. Assumption of Risk  By purchasing and using the Side Load Carrier System, the User voluntarily assumes all risks associated with its use, including but not limited to:  Damage to the vehicle, load, or surrounding property caused by improper installation or overloading.  Personal injury or death caused by product failure due to excessive force, environmental factors, or misuse.  Traffic violations or legal consequences resulting from non-compliance with local, state, or federal transportation laws.  B. Release of Liability  To the fullest extent permitted by law, the User agrees to release, waive, discharge, and hold harmless the Company, its manufacturers, distributors, retailers, employees, and affiliates from any and all claims, damages, liabilities, or expenses arising from the use or misuse of the Product, including:  Negligence (except where prohibited by law).  Incidental or consequential damages, including towing, vehicle repairs, medical costs, or lost wages.  Legal fees or penalties incurred due to improper transport of goods .C. No Warranty or Guarantee  The Company provides this Product "as is" without express or implied warranties of merchantability, fitness for a particular purpose, or durability. The Company does not guarantee that the Product will work for all vehicles, load types, or conditions.

4. USER RESPONSIBILITIES & INDEMNIFICATION  By purchasing and using this Product, the User agrees to:  Comply with all transportation laws in their local jurisdiction regarding oversized loads, required warning flags, and weight limits.  Regularly inspect and maintain the Product to ensure safety and functionality.  Indemnify and defend the Company against any claims, lawsuits, or damages resulting from improper use, installation, or maintenance of the Product.

5. GOVERNING LAW & DISPUTE RESOLUTION  This Agreement shall be governed by the laws of the State of Washington, Seattle, without regard to conflict of law principles.  Any disputes arising out of the use of this Product shall be resolved through binding arbitration in the State of Washington, and the User waives the right to participate in any class action lawsuit against the Company.
